TERMS AND CONDITIONS FOR RENTAL EQUIPMENT FROM SONIC BASS

GENERAL CONDITIONS FOR THE HIRING OF EQUIPMENT

1 – These Terms and Conditions (as amended from time to time by the Company at the Company’s sole discretion) apply to the hire of any goods by the Hirer from Sonic Bass (the Company).

2 – These Conditions are the only conditions upon which the Company is prepared to deal with the Hirer and they shall govern each order for goods by the Hirer from the Company to the entire exclusion of all other terms or conditions (including any terms or conditions which the Hirer purports to apply under any purchase order, confirmation of order, specification or other document).

3 – Each order for goods by the Hirer from the Company shall be deemed to be an offer by the Hirer to hire such goods subject to these Conditions and no order shall be deemed to be accepted by the Company until a written acknowledgment of order is issued by the Company.

4 – It is a condition of hire that all Hirer’s are over the age of 18 and are able to provide at least three current forms of identification, two of them must be photographic. The Company will only accept a current driving licence or  passport, the other  must be a utility bill or bank statement showing the Hirer’s current address and be current to the last two months from date of hire. The Company is under no obligation to accept any form of identification as proof of identity.

5 –The full hire charges must be paid either via PayPal or in cash prior to collection or delivery. A refundable deposit subject to the terms and conditions contained herein must be paid on collection or delivery of the Equipment.

6 – It is the responsibility of the Hirer to collect the goods or provide an authorized representative over the age of 18 years to collect the ordered goods and sign a collection receipt.

7 – The period of hire shall commence at the time when the goods are collected by the Hirer. All quoted prices are for collection of goods, in the event that an additional agreement is made between the Hirer and the Company for the delivery and or installation of the equipment an additional agreed amount will be added to the basic hire costs.

8 – The Hirer undertakes to keep the hired goods in good condition and to return all of them to the Company in the same order and condition in which they were supplied by the Company. 

9 – All equipment must be suitably protected in transit. If the Equipment is to be transported by personnel other than the Hirer then adequate packaging and handling precautions remain the responsibility of the hirer. Equipment may not be moved outside the United Kingdom without the prior consent of the Company.

10 – The Hirer shall be responsible for the cost of repairs for damage, from whatever cause, to any hired goods which arise during the period of hire.

11 – Goods lost or destroyed during the period of hire, whether or not through the fault or negligence of the Hirer will be charged to the Hirer at the current replacement value.  All hire equipment must be maintained in the same working condition and appearance and state of repair as they are at the time of hire and in default of so doing the Hirer shall pay to Sonic Bass on demand the cost of putting the same in such condition appearance and state of repair as aforesaid howsoever any damage may be caused. Sonic Bass reserves the right to set off against any deposit held in respect of any such damage as aforesaid and to appropriate such deposit accordingly.

12 – All hire Equipment must be returned to Sonic Bass’s operating address by the return day as stated in the order collection documents. The Hirer will be liable to pay daily hire rates (as published from time to time on the Sonic Bass website) on any Equipment not returned on time and hereby indemnifies Sonic Bass against any loss claim or damages it may face resulting from the late return of Equipment by the Hirer.

13 – Risk in the hire Equipment will pass immediately to the Hirer when the hire Equipment leaves the official possession or control of Sonic Bass and risk in the hire Equipment will not revert to Sonic Bass until the hire Equipment is back in the physical possession and control of Sonic Bass.

14 – The goods are hired out by the Company on loan to the Hirer. Under no circumstances, shall the Hirer deem the goods sold, or for sale to, or the property of the Hirer.

15 – The Company will endeavor to meet all commitments relating to the hired goods which have been expressly agreed in writing with the Hirer but cannot be held responsible for delays due to circumstances beyond its control.

16 – The Hirer agrees that the Company will not be liable for any loss (including, without limitation, loss of profits, revenue, contracts, business, anticipated savings, goodwill, reputation, or any indirect or consequential losses), claims, costs, damages, charges or expenses arising out of or in connection with the use or otherwise of any item hired by the Hirer from the Company.

17 – It is the Hirer’s responsibility to ensure that the equipment is only used by competent personnel and is only used for its intended purpose and that the equipment is connected correctly and is protected by suitable fuses and proper earthing.

18 – Nothing in these Conditions shall operate to exclude or limit the Company’s liability for death or personal injury caused by the Company’s negligence or fraudulent misrepresentation.

19 – The goods are provided to the Hirer “as is” and without warranty of any kind, whether express or implied, written or oral. The Company disclaims, to the fullest extent permitted by law, all warranties, whether express or implied, written or oral, with respect to the goods, including any warranty of fitness for a particular purpose.

20 – If any provision of these Conditions shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability shall not affect the other provisions of these Conditions which shall remain in full force and effect.

21 – No variation to these Conditions shall have any effect unless expressly agreed in writing and signed by an authorized representative of the Hirer and the Company.

22 – Except insofar as these Conditions expressly provide that a third party may in his own right enforce a term of these Conditions, a person who is not a party to these Conditions has no right under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of these Conditions but this does not affect any right or remedy of a third party which exists or is available apart from that Act.

23 – The validity, construction and performance of these Conditions (and any claim, dispute or matter arising under or in connection with them or their enforceability) shall be governed by and construed in accordance with the law of England. Each party irrevocably submits to the exclusive jurisdiction of the English courts over any claim, dispute or matter arising under or in connection with these Conditions or their enforceability.

24 – The company will keep your details on photocopy or electronic file for up to six months after your hire date.
